I refer to your Official Information Act 1982 (OIA) request of 14 July 2025 below.

Police have transferred your request in two parts to Ministry of Justice, and to Wanganui District Council, as the information to which your request relates is not held by Police, but is held by these agencies.
In these circumstances, we are required by section 14 of the OIA to transfer your request.

To Ministry of Justice:

Thank you for your assistance in responding to my request so far.

While part of my request has been fulfilled by the Ministry of Justice, the following part of my request is still unanswered:

To Whanganui District Council (under the LGOIMA):
The number of charges, prosecutions and convictions under the Wanganui District Council (Prohibition of Gang Insignia) Act 2009. To be clear, I request data for these Acts from the date of royal assent to the date of repeal for each Act.

I have received personal communication from the Whanganui District Council that:
"Whanganui District Council do not hold this information, any details relating to criminal charges, prosecutions and convictions relating to the Wanganui District Council (Prohibition of Gang Insignia) Act 2009 will be held by the Police certainly in respect of charges, and both the Police and Ministry of Justice in respect of Charges and Prosecutions. We do not accept transfer of the request."

Would it please be possible to confirm that this part of my request has been transferred either to Police or the Ministry of Justice to be answered?

the delay and reassure you that the Police data team are in the final
stages of review and approval, then the response will be release to you.

 

You have the right, under section 28(3) of the OIA, to make a complaint to
