The Ministry of Economic Development earlier this year launched a 'Mobile Business Toolbox' app for the iPad (http://www.business.govt.nz/mobile-toolbox). I would like to request under the Official Information Act:

* the source-code of the Mobile Business Toolbox app.
* the cost of developing this app

Feel free to contact me if you want me to clarify my request: I can imagine a request for source code maybe somewhat different than a normal OIA request.

Dear FYI Requests,

I just had a few questions of clarification following your reply to my OIA request that I was hoping you could answer:

First: the letter states that the reason for decline is under s9(2)(b), and then lists either s9(2)(b)(i) or s9(2)(b)(ii) as the reason for declining. Can you please identify which of (i) or (ii) was the reason for decline? Alternatively, was the reason for reply meant to be both (i) and (ii), rather than either or?

Second: can you please provide the explanation why answering my OIA request would result in compromising the values protected by s9(2)(b)? Although you have identified the protected interest, the letter did not explain the reason why disclosure would compromise the protected values. Afterall, the Ombudsmen guidelines say that for declining under s9(2)(b) "The agency must be able to explain precisely how the predicted harm or damage would be likely to result if the requested information was released".

Third: s9(2)(b) is generally aimed at information that is owned by a third party and just held by the agency, or alternatively where the agency is involved in a commercial function. May I clarify here whether MoBIE owns the code, or whether ownership and control of the code is still retained by the third party that developed the code?
