Dear Department of the Prime Minister and Cabinet,

I write to request a copies of:
* the 2012 Legislative Programme, as referred to in Cabinet Circular CO(11)11; and
* the 2011 Legislative Programme, as referred to in Cabinet Circular CO(10)04.

If this request is declined on the basis that the information requested is publicly available, or will shortly become publicly available, please treat this as a request for information on where these documents are available, or when and where these documents will be publicly available.

It is likely that this request will be refused for the 2012 legislative program, as the Ombudsmen has previously ruled that it can be withheld under s9(2)(f)(iv), the section protecting confidentiality of advice tendered by Ministers and officials. See the article intitled "Intended Legislative Programme Able to be Withheld under OIA" here: http://www.ombudsmen.parliament.nz/image....

Of course, the same argument wouldn't apply for the 2011 programme.

Thanks, that is interesting. That article suggests that the "intended but not final" programme can be withheld. Creates an interesting incentive to never finalise it!
