Clarification of the DCC boundary.
Karen Anderson made this Official Information request to Dunedin City Council
Response to this request is long overdue. By law Dunedin City Council should have responded by now (details and exceptions). The requester can complain to the Ombudsman.
From: Karen Anderson
Dear Dunedin City Council,
My preference is to receive the requested information by email.
Amendments to the Dog Control Bylaw maps show the DCC boundary extending down to MLWS. This clearly asserts the DCC Dog Control Bylaw applies and is enforced by the DCC to that point.
This issue arose during the Reserves and Beaches Bylaw review in 2017. Otago Regional Council wrote to the DCC because the ORC is the controlling authority for the area between MHWS and MLWS. I understand the letter also addressed issues arising when the media reported statements by the DCC that were false or misleading concerning existing ORC rules that apply in that strip, and the ORC’s intentions concerning those rules.
Last week the ORC advised me they are not aware of any changes that have would change the controlling authority for this area. Accordingly I have been requested by members of the Dunedin Dog Bylaw Group to ask what changes have occurred that removed authority over the area between MHWS and MLWS from ORC and vested it in the DCC. As that is a formal process, please also provide copies of all relevant documentation.
Yours faithfully,
Karen Anderson
