The Office of the Ombudsman has advised the Ministry that you have
complained about the response to your request under the Official
Information Act 1982 (‘the OIA’) for information about the appointments of
Chen Zhi and Zheng Shijia (‘the applicants’) as Justices of the Peace.
Having considered your complaint and reflected further, we are no longer
of the view that s 9(2)(a) of the OIA applies to some of the information
you had requested, namely: i) the sections of the applicants’ JP
nomination forms completed by their local electorate MPs; and ii)
correspondence between Jami-Lee Ross MP and the office of the Hon Simon
Bridges relating to the nomination of Mr Zheng. Please find copies of
this information attached. We remain of the view that it was appropriate
to withhold the rest of the information you had requested under ss 9(2)(a)
and 9(2)(ba)(i) of the OIA.
I understand that the Office of the Ombudsman are continuing to consider
the remaining aspects of your complaint.

Good afternoon Mr Luke
I refer to my email below.
You may be aware that, as part of its ongoing investigation into your
complaint, the Office of the Ombudsman have asked the Ministry to consult
with Mr Zheng and Mr Chen as to whether they would object to the release
to you of the information that was withheld to protect their privacy.
This applies to their curriculum vitaes, the sections of the nomination
forms that were completed by them, the Ministry of Justice criminal
records checks, and the sections of the Minister’s decision forms that
contain their personal information.
We have undertaken this consultation as requested. Mr Zheng has agreed
for this information to be released, but Mr Chen has not. Please find a
copy of the information relating to Mr Zheng attached.
As before, I understand that the Office of the Ombudsman will continue to
consider the remaining aspects of your complaint.

Good morning Mr Luke
As you will be aware, the Office of the Ombudsman has released a
provisional opinion in relation to the above complaint. Its provisional
view is that the Ministry was entitled to withhold the majority of the
information you requested under the Official Information Act 1982, but
that it should not have withheld Mr Chen’s curriculum vitae (‘CV’) to the
extent that it contains publicly available information. Having considered
the Office of Ombudsman’s provisional opinion, the Ministry has agreed to
release the attached redacted version of Mr Chen’s CV.
As before, I understand that the Office of the Ombudsman will continue to
consider the remaining aspects of your complaint.
