This is a freedom of information request, pursuant to corresponding freedom of information and official information acts. I am a scholar with the Council on Foreign Relations think tank. I also am a writer for World Politics Review website, and the Washington Monthly magazine, as well as other publications.

I would like to make a request for the following documents, if they exist, from within the Ministry of Foreign Affairs and Trade. Please search files from the main ministry, as well as the New Zealand embassy in Beijing.

Any and all reports, analysis, cables, documentation, or other written items, between January 1, 2017 and August 9,2018, that contain the following phrases:
1. “China AND public diplomacy”
2. “China AND soft power”

This one won't fly. The OIA only allows NZ citizens or permanent residents of NZ to request official information. And in any case it would probably be refused as it requires "substantial collation or research".

The provision of information relating to the work of New Zealand Government agencies, such as the Ministry of Foreign Affairs and Trade, is governed by New Zealand's Official Information Act 1982 (OIA). The purpose of the OIA, amongst other things, is to progress the availability of information to the people of New Zealand to enable effective participation in the making and administration of laws and to hold Ministers and civil servants accountable. The OIA specifies who can rely on its provisions and seek information from government agencies. This criteria is found in section 12(1) of the OIA and provides:

Any person, being-

(a) A New Zealand citizen; or
(b) A permanent resident of New Zealand; or
(c) A person who is in New Zealand; or
(d) A body corporate which is incorporated in New Zealand; or
(e) A body corporate which is incorporated outside New Zealand but which has a place of business in New Zealand.

I refer to your email of 10 August 2018 in which you request the following
under the Official Information Act 1982 (OIA):

As noted in our email of 13 August 2018, the OIA specifies who can rely on
its provisions and seek information from government agencies. These
criteria are found in section 12(1) of the OIA and provides:

Any person, being-

(a) A New Zealand citizen; or
(b) A permanent resident of New Zealand; or
(c) A person who is in New Zealand; or
(d) A body corporate which is incorporated in New Zealand; or
(e) A body corporate which is incorporated outside New Zealand but which
has a place of business in New Zealand.

You have confirmed that you do not meet these requirements and therefore
we will be taking no further action on your request.

 

You have the right under section 28(3) of the OIA to seek a review of this
response by the Ombudsman.
