Thank you for your email of 21 March 2018 requesting the following
information:
“I would like to request a breakdown of the legal expences from the
defence of a ACC or Fairways Decision incured in the District Court, High
Court, Court of Appeal Surpreme Court Years 2014.15.16,17, The numer of
claimints for each year The potenial cost savings/estimate/losses for each
year.”
Due to the nature of your request, ACC is treating it as a request for
information under the Official Information Act 1982 (the Act).
To best address your request we have separated it into three parts as
follows:
1. “…breakdown of the legal expences from the defence of a ACC or
Fairways Decision incured in the District Court, High Court, Court of
Appeal Surpreme Court Years 2014.15.16,17”
2. “The numer of claimints for each year”
3. “The potenial cost savings/estimate/losses for each year.”
We have interpreted part 2 of your request as asking how many claimants
the 2014 to 2017 legal costs in part 1 are associated with.
Regarding part 3 of your request, under section 12(2) of the Act, a
request for information must be specified with due particularity. Would
you please clarify what you mean by the phrase ‘potential cost
savings/estimate/losses’? For example, describe which cost(s) you are
referring to?
Please provide clarification by Monday 9 April 2018. If we have not heard
back from you by then, we will proceed to make a decision, under the Act,
on your request as it is now.

Dear Government Services,
Thank you for your reply, to clarafy Iam asking whether there is data relating to the estimated costs of a claim for rehabilitation, and if there data for estimated legal costs in defending a decision. ie if a claim for rehab is esimated at $10,000 and a decision to decline cover incurred legal costs of $8000, then a savings of $2000 is achieved. On the other hand if legal cost amount to $12000 then the decision would be a loss.
