Dear Mr Rhys West,

On 26 May 2017 Miriam R Dean CNZM QC made public her review titled "INDEPENDENT REVIEW OF THE ACCLAIM OTAGO (INC) JULY 2015 REPORT INTO ACCIDENT COMPENSATION DISPUTE RESOLUTION PROCESSES".

On page 27 of the referred review Miriam Dean's states and I quote;

"Reviewers’ preparedness: Several interviewees said that reviewers were not reading the review file in preparation for the hearing. Nor, they added, could reviewers do so when paid only “$450 a case”.62 FairWay acknowledged that in the past some reviewers did not read the file until the hearing, preferring to hear from both sides in person. But FairWay now insists reviewers read the file beforehand – critical, this review considers, to “being heard”."

Representitves of FairWay who attended the independent review proceedings prior to the 26 May 2017which Miriam Dean facilitated advised Miriam Dean that as at, or prior to the review by Miriam Dean, that Fairway insisted reviewers read the review file beforehand, meaning the full file before the review takes place.

OIA Request 1:

Mr Rhys West, as CEO of FairWay Resolution Limited, I welcome your provision to me of copies of the original official policy and all assisted official information that FairWay Resolution Limited made available to Reviewers of ACC decisions, fully informing reviewers that they were required to have been fully prepared prior to commencing a review by having read the applicants full review file.

Please ensure that all correspondence is supplied, and as such is dated. Please confirm the date when FairWay Resolution Limited first commenced instructing reviewers that they are required to have fully read the applicants full review file, inclusive of information provided prior to the review by ACC claimant before the reviewer commences review proceedings so that the the ACC claimant can be seen as to have been fully heard at review.

I thank you for your time and assistance and look forward to receiving the requested official information back via FYI.org.nz, within the next 20 working days, being by the end of business close on the 8th August 2017.
