onboard CCTV footage for the 392 service around 12:30pm to 12:45pm in the
Pukekohe area.   Although a date of the incident wasn’t provided, I have
taken it to be the date of your request.  If this is not correct, please
advise me as soon as you can.

 

We are processing your request according to the provisions of the Local
Government Official Information and Meetings Act 1987. You will receive a
response within 20 working days after the receipt of your request by
Auckland Transport, as required by the Act. The expected due date for a
response is 18 July 2017.  Please note this is the maximum response time
and we will endeavour to respond to you sooner.

 

If footage of the incident is found, we will save the footage however,
please be advised that we can only release this footage directly to the NZ
Police upon receipt of a request from them.   If you have a police event
number or file reference, please advise the writer so that we may update
our records.

At the outset, please accept our sincere apologies for the delayed
response.  We believed that this response had been sent to you on 13 July
2017 but recently found no evidence to support that.  I am truly sorry for
this oversight.

Thank you for your email.  The summary of events were released in
accordance with section 15(1) of the LGOIMA. 

 

As advised in our letter, footage can be released directly to the person
captured in the footage under the Privacy Act 1993.  It would require your
friend to make a request under the Privacy Act 1993 directly to Ritchies
Transport who hold the footage.  The bus operator would then need to
blur/pixelate other passengers captured on film so that their privacy is
maintained. 

 

The alternative would be to release the footage directly to the Police
upon receipt of a request from them.

 

We hope this explanation clarifies our position on the matter.
