ACC complaints/concerns process when they suspect misconduct with Medical Professional or Service
Anthony Jordan made this Official Information request to Accident Compensation Corporation
The request was successful.
From: Anthony Jordan
Dear Accident Compensation Corporation,
It has been noted very well publicly that ACC third party doctors and service providers are not investigated or that complaints dont come under the Health and Disability Commissioner or Medical Council.
1/ who does ACC refer thier concerns to when suspecting general misconduct or in breach of Claimants rights
2/ what cases in the last 15 years has ACC lodged a complaint about (without disclosing names but instead thier profession)
3) out of those complaints lodged, how many were upheld
4) are there any pending complaints or concerns currently been investigated regarding any ACC accredited doctors/service providers that ACC themselves have initiated based on thier own unease. If so what are thier service to ACC
Yours faithfully,
Anthony Jordan

Dear Mr Jordan
Official Information Act request
Thank you for your email of 11 May 2017 requesting the following
information under the Official Information Act 1982 (the Act):
“It has been noted very well publicly that ACC third party doctors and
service providers are not investigated or that complaints don’t come under
the Health and Disability Commissioner or Medical Council.
1/ who does ACC refer their concerns to when suspecting general misconduct
or in breach of Claimants rights
2/ what cases in the last 15 years has ACC lodged a complaint about
(without disclosing names but instead their profession)
3) out of those complaints lodged, how many were upheld
4) are there any pending complaints or concerns currently been
investigated regarding any ACC accredited doctors/service providers that
ACC themselves have initiated based on their own unease. If so what are
their service to ACC”.
This email is to inform you that we are working on your request and will
be in touch with you as soon as possible, and certainly by 9 June 2017.

you to resolve these. We can be contacted by email at

Dear Mr Jordan
We write again regarding your Official Information Act request,
specifically the following questions:
“2) what cases in the last 15 years has ACC lodged a complaint about
(without disclosing names but instead their profession)
3) out of those complaints lodged, how many were upheld”.
We have completed initial investigations into your request and have
confirmed the following:
In 2010, ACC established a new panel to monitor provider conduct. As a
result of this, minutes can be searched from that time to find the
information you have requested in regards to question two. Further
improvements to the monitoring of provider conduct were made in 2016 and
we now have more comprehensive reporting. Prior to 2010 any relevant
documents cannot be easily identified in our system. To find these
documents would require a manual search of files, which may yield no
information.
After carefully considering your request, we have reached the view that
providing a suitable response would require us to undertake substantial
collation and research. We have considered whether fixing a charge or
extending the available timeframes would enable us to grant your request
in its present form.
Unfortunately, the scale of the request determines that neither of those
options would sensibly facilitate our providing the requested information
to you. Searching for, and collating, any available information for
release, would place a significant strain on our resources and would
likely result in the need to pass on the associated cost to you.
To assist you in receiving some relevant information, we would like to
work with you to refine your request by limiting the time period of the
information provided to 2010-2017. Would you please reply to confirm you
agree to this, by 6 June 2017? If we do not hear from you by that date, we
will take this as agreement of the new scope for the requested
information.
Kind regards
OIA Services, Government Engagement and Support

Dear Government Services,
Many thanks for your reply and investigations. The timeframe post 2010 that ACC are prepared to release without cost is helpful and acceptable.
Yours sincerely,
Anthony Jordan

Dear Mr Jordan
Thank you for replying to us to confirm that you accept our proposed
refinement of your request to provide data from 2010-2017.
This email is to inform you that we require an extension of time to
prepare our response to your request until 23 June 2017. This is because,
as explained in our previous email, the request necessitates a search
through a large quantity of information.
We will do all we can to respond to your request before the new due date,
if that is at all possible.
This extension complies with section 15A(1)(a) of the Act.
In the meantime, if you have any questions we will be happy to work with
you to resolve these. We can be contacted by email at
[1][email address].
Kind regards
