Two year old unanswered questions

David Horwood made this Official Information request to Opotiki District Council

The request was refused by Opotiki District Council.

From: David Horwood

Dear Opotiki District Council,

After discussions with the Ombudsman's Office they have informed us that the LGOIMA legislation refers to information already in existence and therefore some previous questions we have asked of you do not strictly come under this Act.

However, as some questions we have asked relate to information:
-which should have already been provided to us in our Building Consent,
- about how the inspection processes are carried out
- that should be able to be answered over the desk at council
we are totally entitled to an answer.

Therefore we will ask the following questions again - not under LGOIMA. We would like non-evasive answers please. If these are not provided, the Ombudsman's Office has assured us that they will investigate.

Question 1:
In 2008 under which building inspection sheet should the first cladding inspection have taken place? (Note: the 2008 pre-clad inspection sheet has provision for inspecting the cladding e.g. 'cladding fixing details' and 'flashing requirements/fixing/position'. The 2008 pre-line inspection sheet has no provision at all for cladding/flashing inspection points).

Question 2:
You have supplied us with property file 1482 which is also a Shadowclad home and was inspected using the same inspection sheets as ours. Their 'cladding fixing details' were ticked as 'per approved plan' (and has got CCC) yet our 'cladding fixing details' were marked as 'not applicable'. As you are aware, our cladding fixing details are not as per the approved plans and we now have to totally re-clad our home.

Has our pre-clad inspection sheet been filled in correctly? If yes, could you please explain why.

Yours faithfully,

David Horwood

The Opotiki District Council have a view that what was being sought is not covered under LGOIM & recommend that the requester put their query to the Council through their lawyers (the requesters & the Councils)
