LOPE rate if having worked

Dear Accident Compensation Corporation,

I am told LOPE for injuries as child is 80% of minimum wage only. I am told potential or actual earnings derived from actual work experience are not being used to calculate the rates of LOPE payment.

1. What legislation including relevant section and clauses prevents LOPE being paid at the rate of 80% actual income or 80% of potential income?
2. What legislation including relevant sections and clauses requires LOPE to be paid at 80% minimum wage rate when work evidence exists thus potential earnings are known?
3. Has there been any reviews or Court rulings of ACC LOPE decisions to pay LOPE at 80% of min wage rate and if so the outcome of and name of the Court case review etc.
4. Has ACC paid LOPE for injuries as a child at a rate other than 80% of minimum wage to any client and if so how many clients and was this done in the original rate setting or upon review or Court ruling.
