Dear Ministry of Justice,

I request official information under the Official Information Act 1982.

Please deal with the following 2 parts separately.

Part 1: Provisions in the 2009 Immigration Bill concerning acting otherwise than in good faith

The scope of this part is limited to the parts concerning acting otherwise than in good faith in the relevant provisions inserted into or amended in the Immigration Bill by Supplementary Order Paper No 32 on 15 September 2009.

This request covers the relevant Immigration Bill provisions and their corresponding provisions in the Immigration Act 2009 after enactment, including clauses 125, 130, 176C and 178 of the Immigration Bill, and sections 134, 140, 197 and 200 of the Immigration Act 2009.

Please provide official information held by the Ministry of Justice showing whether the provisions within the above limited scope were subject to a New Zealand Bill of Rights Act 1990 consistency review, analysis relating to section 7 of that Act, a Human Rights Act 1993 review, a human rights assessment, or a discrimination assessment.

Where such a review, analysis, or assessment took place, please provide the corresponding review, analysis, or assessment material.

Part 2: Provisions or proposals concerning bad faith or acting otherwise than in good faith in Parliamentary Paper J.24

The scope of this part is limited to the parts concerning bad faith or acting otherwise than in good faith in Parliamentary Paper J.24: Proposed policy additions to the Immigration (Enhanced Risk Management) Amendment Bill and in the policy proposals described in J.24.

Please provide official information held by the Ministry of Justice showing whether the provisions or proposals within the above limited scope were subject to a New Zealand Bill of Rights Act 1990 consistency review, analysis relating to section 7 of that Act, a Human Rights Act 1993 review, a human rights assessment, or a discrimination assessment.

Where such a review, analysis, or assessment took place, please provide the corresponding review, analysis, or assessment material.
