A Question of Authority
Ronald van der Horst made this Official Information request to Inland Revenue Department
The request was refused by Inland Revenue Department.
From: Ronald van der Horst
Dear Inland Revenue Department,
With regard to;
Income Tax Act 2004
AA 1 Purpose of Act
The main purposes of this Act are—
(a) to define, and impose tax on, net income:
(b) to impose obligations concerning tax:
(c) to set out rules for calculating tax and for satisfying the obligations imposed.
My question is this;
By "whose" or "what" authority is a tax imposed?
Kind Regards,
Ronald van der Horst.

Dear Tony Ponoghue (Commissioners Correspondence),
Thank you for your reply and the information contained there-in.
Sadly, though close, the information provided was not the information sought. Happily it has has provided an opportunity to request again, perhaps with a little more clarity on my part.
With regard to; Judge Thomas (Penlington in Warren v Police 9 Feb 2000, High Court Hamilton, AP 133/99:)
1. The New Zealand Parliament is empowered to make legislation.
Request: By what or whose authority is The New Zealand Parliament empowered to make legislation?
2.The Acts of Parliament do not derive their authority from the Treaty of Waitangi or the Declaration of Independence.
Request: From what or whose authority do the Acts of Parliament derive their authority?
3. The Acts of Parliament are binding on all persons within the territory of New Zealand, pakeha and Maori.
Request: By what or whose authority are the Acts of Parliament binding on all persons within the territory of New Zealand, pakeha and Maori?
Though seeming many; they are in essence one request- assuming one authority.
Thank you once again,
Kind Regards,
Ronald van der Horst

I could not leave an annotation regarding Ronalds request regarding interpretation, so I will try here. I found the response interesting and it clarifies my understanding that the legal system is actually a closed system, we know the information is in the public domain somewhere but no effort ever goes into educating the public of civics, their rights, how to access case law and other law related information portals and in general the complex, occult workings of the legal and lawful mechanisms that underpin every aspect of ones existence. The question 'why'? arises, and using everyday logic one must assume it's because the justice system and law society do not want the public to be informed in these matters.
