I am going to be drafting the response to your recent request to the
Ministry of Education for official information:

 

Please provide me with the number of students who have first enrolled at a
school between their 6th and 7th birthdays (i.e. as provided for by
section 20 (2) of the Act). I would prefer a total per year for the years
2004-2014, if that is available.

 

I am writing to see if you are able to clarify your request. 

 

You refer to section 20(2) of the Education Act 1989 – I have copied 20(1)
and 20(2) below.  My query is about the information you are wanting. 
Would you like to know the number of students who first enrolled between
their 6^th and 7^th birthdays?  Or those who did not enrol during that
time, because they were more than 3 kilometres walking distance from
home?  Alternatively, please tell me whether you wish to know something
else about enrolment numbers.

Part 3 Enrolment and attendance of students

20 New Zealand citizens and residents between 6 and 16 to go to school

(1)

Except as provided in this Act, every person who is not an international
student is required to be enrolled at a registered school at all times
during the period beginning on the person’s sixth birthday and ending on
the person’s 16th birthday.

(2)

Before a child’s seventh birthday, the child is not required to be
enrolled at any school more than 3 kilometres walking distance from the
child’s residence.

Dear Claire Cohen,

Yes, the number of students who did not first enrol by their 6th birthday (as required by 20(1)), because they were more than 3km walking distance from any school (as provided for in 20(2)).

So this would be the number of students that first enrolled between their 6th and 7th birthdays, but only for that reason (i.e. not students who illegally failed to enrol, students not in NZ during that time, students that the Secretary exempted).

Essentially, how frequently is section 20(2) actually used.
