On 8 July 2015 you emailed the Ministry requesting, under the Official
 Information Act 1982, the following information:
·         Please provide all information on a forthcoming high court
 appeal against the deduction of Canada Pension Plan from NZ
 superannuation. The date of the appeal is set for 22nd  September 2015.
 
I can inform you that no information has been prepared for the upcoming
 High Court appeal concerning the deduction of the Canada Pension Plan
 scheduled on 22 September 2015. As such your request for this information
 is refused under section 18(e) of the Official Information Act as this
 information does not exist.
I am sorry I could not be more help in this instance. You have the right

o Is the Ministry aware of, and party to, a hearing in the High Court on
 the 22^nd of September 2015 to deal with an appeal against the
 deduction of the Canada Pension Plan from New Zealand Superannuation?
I can inform you that the Ministry is aware and is party to the High Court
 appeal regarding the deduction of Canadian pensions from New Zealand
 Superannuation payments.
I note on the 8 July 2015, you previously requested copies of any
 information that the Ministry had prepared for this appeal. As this case
 has yet to be considered by the High Court, any information prepared by
 the Ministry in relation to this case would be withheld under section
 9(2)(h) of the Official Information Act in order to maintain legal
 professional privilege. The greater public interest is in ensuring that
 government agencies can continue to obtain confidential legal advice.
