Dear Ministry of Justice,

Please provide the impact / assessment of Bill of Rights and Human Rights Act 1993 in relation to introduction and amendment of AML / CTF Act when it comes to housing status of people who would be impacted on when opening bank accounts.

In addition provide the documented process used to identify, engage and consult with people, communities and groups who have an interest in relation to AML/CTF law & regulations impact to homeless population.

Also please provide the documents resulting from that consultation.

Thank you for the two emails sent to the Ministry of Justice (the
Ministry) on 17 October 2024.

 

We acknowledge receipt of your request under the Official Information Act
1982.  Specifically, you requested:

 

“Please provide the impact / assessment of Bill of Rights and Human Rights
Act 1993 in relation to introduction and amendment of AML / CTF Act when
it comes to housing status of people who would be impacted on when opening
bank accounts.

 

In addition provide the documented process used to identify, engage and
consult with people, communities and groups who have an interest in
relation to AML/CTF law & regulations impact to homeless population.

 

Also please provide the documents resulting from that consultation.

 

Please provide the documented guidance provided to reporting entities how
to be compliant with s. 15(d) and 16(1)(a) of the AML/CFT Act when the
person is of No fixed abode.

 

Also please provide the list of entities and date the guidance has been
provided if this is available.”
