From: P Robins
Dear Simon Court,
I am writing to follow up on my Official Information Act (OIA) request relating to your responsibilites, which remains overdue. As you are aware, under the provisions of the Official Information Act, Parliamentary Under-Secretaries are subject to the same requirements as Ministers, including the obligation to respond within the statutory timeframe. The deadline for providing the requested information has now passed, and I have yet to receive a response or an update on the status of my request.
I would be grateful if you could provide an update on when I can expect to receive the requested information. If there have been any delays, I kindly ask that you provide a revised timeline for the response and any reasons for the delay.
I trust you will give this matter your urgent attention, as timely access to information is a cornerstone of transparency under the OIA. I look forward to your prompt reply.
Yours faithfully,
P Robins

Thank you for contacting Simon Court MP, Parliamentary Under-Secretary to
the Minister for Infrastructure and Minister for RMA Reform (and ACT
spokesperson for Energy & Resources and Climate Change).
As Simon receives a large amount of correspondence, it is not always
possible to personally reply to all emails. The following guidelines
apply:
* Invitations and requests to meet with Simon Court will be considered and
a staff member will be in touch with you in due course. Please note it is
not always possible to respond immediately.
* Portfolio and spokesperson-related correspondence will be considered and
responded to where appropriate.
* If your email falls outside Simon Court’s portfolio or spokesperson
responsibilities, your correspondence may be transferred to another office
or MP.
* Requests for official information will be managed in accordance with the
provisions of the Official Information Act 1982, which may include a
transfer to a more relevant Minister or agency.
* If your email expresses a personal view, or is copied to multiple
Members of Parliament, then your opinion will be noted and there may be no
further response.
Thank you once again for taking the time to write; it is very much
appreciated.
Regards

This email is to confirm the receipt of your request under the Official
Information Act 1982 for “…a list of briefings and advice you have
received since being sworn in as Parliamentary Under-Secretary to the
Minister for Infrastructure and Minister Responsible for RMA Reform.”
We would firstly like to acknowledge the delay in response to your
request. Through the link you provided to this office on 2 December 2024
pertaining to your request, we have been made aware of an apparent initial
request on 27 September 2024, followed by a reminder on 27 October 2024
and a subsequent reminder on 24 November 2024.
Upon receipt of your 24 November 2024 email, having not been aware of
prior correspondence, we conducted a search to identify the request that
email pertained to in case we had missed something. This search did not
find any previous correspondence from you pertaining to this request.
We also note that it is this 24 November 2024 email that generated the
first response to you from this office, which was in the form of an
autoreply that was not similarly generated on either 27 September or 27
October 2024.
Now being aware of earlier attempts to make contact, and having been
unable to find those prior emails, it appears there may have been an error
in either their sending or receipt that led to them not being received by
this office. If you would be willing to provide attachments of the 27
September and 27 October 2024 emails, it may help us troubleshoot any
potential issues, so they are addressed going forward.
In case it is relevant here, the official email for Parliamentary
Under-Secretary Simon Court is: [1][email address]. As he
is an Under-Secretary and not a Minister, this email format differs from
most other members of the Executive who are Ministers. You can find more
information about Under-Secretary Court, including speeches, press
releases, and diary releases, here:
[2]https://www.beehive.govt.nz/minister/sim....
The request from this office for a copy of your original request on 25
November 2024, responding to your email from 24 November 2024, might now
make more sense in light of the aforementioned issue. We acknowledge the
receipt of your response to this on 2 December and thank you for providing
us the information about the initial request at:
[3]https://fyi.org.nz/request/28546-briefin....
Given 2 December was the first point at which we had the necessary
information about the request to respond to, we are intending to treat
this as the date of the receipt of the request. While we acknowledge the
delay and frustration this may cause, we will work to provide you with a
response to this request as soon as possible and will be in touch in due
course should there be anything to clarify or any updates. Further, if you
would like to discuss or raise concerns in relation to any of this, we
encourage you to give us a call so we can work through how we might be
able to work through any of this.
Please note you have the right to seek an investigation and review by the
Ombudsman, in accordance with section 28(3) of the Act. The relevant
details can be found on the Ombudsman’s website at:

Sincerely
Office of Simon Court MP
Parliamentary Under-Secretary to the Minister for
