I refer to your official information request dated 2 August 2024 for a
copy of Dame Cheryll Sotheran’s Strategic Review Report of MOTAT (the
‘Report’)

 

Auckland Council advised us on 8 August 2024 that you requested a copy of
the Report and have transferred your request to us pursuant to section
12(b)(ii) of the LGOIMA.

 

We have received several LGOIMA requests for a copy of the Report since
its production in 2012 and this culminated in the Chief Ombudsman issuing
a provisional opinion in October 2015 confirming that, while there were
good reasons for MOTAT to withhold parts of the Report pursuant to
sections 7(2)(a), 7(2)(c), and 7(2)(f)(i) of the LGOIMA, MOTAT could
comply with its obligations by releasing a redacted version of the
Report’s Executive Summary and Recommendations.

 

In the light of your request, please find attached a redacted copy of the
Report’s Executive Summary and Recommendations in line with the Chief
Ombudsman’s provisional opinion. Please note, the redactions are required
to protect the privacy of natural persons, as required under section 7 of
the Local Government Official Information and Meetings Act 1987.

 

As your request for a copy of the Report has not been granted in full, you
have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
