Frank, strongly I recommend making two complaints to the Ombudsman now (no need to keep waiting). It's important to make complaints, so that Ministers and agencies know that if they break the law they will eventually have to deal with an investigation.

1. Shane Reti: Unlawful late transfer. Transfers must be made within 10 working days of the request (OIA s 14). For your request of 9 April, the last day to transfer was 24 April. Reti did not transfer until 1 May, wasting an extra week.

2. Health NZ:
(1) The "decision" sent to you on 1 July does not say what the decision actually is - whether your request is granted in full, or refused in full or in part, and for what reasons. This is a requirement of decision notices.

(2) Undue delay. While an agency can decide to release information later than the decision notice, it must still be without "undue delay" (OIA s 28(5)). Recent Ombudsman decisions on upper limits have ranged about 4-8 weeks. We are now at 12 weeks since the supposed "decision." This is a clear-cut case of "undue delay" which the Ombudsman must treat as an unlawful refusal.

Note also that:
(3) Even if you accept the "decision" notice, as they gave no withholding reasons you should take this to mean your request has been granted in full. When you finally receive the information if anything at all is withheld then this is also unlawful. If that happens, you should add that to your Ombudsman complaint.

There are several other aspects which are also likely unlawful (extending on the 20th working day, what can lawfully be called "consultations," and whether they truly spent the last three months "collating" the material rather than deciding what to withhold) but that is enough to start with.
