Thank you for your email of 16 March 2024 to the Ministry of Education
(the Ministry) requesting the following information:
1. How many of your staff work from home on a permanent basis.
2. Approximately what proportion of your staff are in the office each
day, on average.
3. If you do not have the above information, please provide any
information you have created within the last 12 months (including but
not limited to internal emails) discussing the extent to which
Ministry staff attend the office versus working from home.
Your request has been considered under the Official Information Act 1982
(the Act).
In response to parts 1 and 2 of your request the Ministry does not collect
data on which staff are working from home on a permanent or day-to-day
basis, and therefore cannot determine staffing occupancy levels. These
arrangements are organised at a team level and not captured centrally to
the level of detail sought. As such, I am refusing these parts of your
request under section 18(g) of the Act, as the information is not held by
the Ministry, and I have no grounds for believing that the information is
either held by, or more closely connected to the functions of, another
department or organisation subject to the Act.
In response to part 3 of your request, as noted above, working from home
arrangements are arranged at a team level, and the information requested
is not captured centrally. As such, I am refusing this part of your
request under section 18(g) of the Act, as the information is not held by
the Ministry, and I have no grounds for believing that the information is
either held by, or more closely connected to the functions of, another
department or organisation subject to the Act.
I can advise however that the Ministry responded to a previous request in
December 2022 for our working from home policy. That response has been

Dear Enquiries National,
Thank you for your response. You say that the information is not held "by the Ministry" but also state that such arrangements are reached at a team level. Those teams are, in fact, the Ministry, and arrangements which those teams have reached are information that is held by the Ministry. You cannot therefore refuse to provide the information on the basis that it does not exist, while at the same time confirming that it does exist (although it is not held centrally).
This being the case, please can you review your response and consider how to provide the information that is held at the level of individual teams or, alternatively, refusing on some other grounds.
You will appreciate that this is not to be treated as a new request under the OIA. I am simply giving you an opportunity to respond to my original request in a way that complies with the OIA.
