Requests for correction of information under Privacy Act at CYF

Dear Ministry of Social Development,

May I kindly request the following information in relation to the processing of privacy requests for correction at CYF for the past 10 years with per year separation:

1. Total number of requests to correct information under Privacy Act.

2. Number of requests, where information requested to be corrected was originally obtained by CYF without any contact with the requestor.

3. Number of intakes, initiated by CYF, where information (being a subject for request to be corrected at earlier or later stage) was used in intake investigations without being corrected.
That usually happens due to the fact of ignoring Privacy Act procedure of obtaining personal information directly from the person, resulting in request for correction being received on a later stage or due to subsequent ignorance of them from CYF side in any form.

4. Number of intakes, which were reopened for review after receiving request for correction, due to false information collected and used in a breach of Privacy Act.

5. Number of requests to correct information under Privacy Act, where request for correction was actioned as simple additional record on the file without any modification to the original records.

6. Number of requests to correct information under Privacy Act, which was actioned (in any form) ONLY after involvement of Privacy Commissioner being simply ignored before that.

The response confirms the general practice of misuse of MSD services for harassment and defamatory purpose.

e.g. anyone can provide deliberately false harassment and defamatory information to MSD and they will keep an accurate record of it, will widely use it without confirming with the person, who's personal information has been presented, reproduce in their assessment as true statements and share with other agencies in a form of various reports without any ability to remove or correct this information.
