I refer to your request of 25 February 2024. As consultations necessary to
make a decision on your request are such that a response cannot reasonably
be given within the original time limit, the University has extended the
time limit for your request under section 15A(1)(b) of the OIA for 20
working days. The new maximum time limit for the University’s response is
23 April 2024; we will respond to your request as soon as reasonably
practicable. You have the right to make a complaint to an Ombudsman if you
are dissatisfied with this extension.

section 9(2)(ba)(ii) of the OIA.
 2. Information that, if disclosed, would be likely to unreasonably
prejudice the commercial position of the University of Auckland or the
Eden Park Trust is withheld under section 9(2)(b)(ii) of the OIA.
 3. Information that it is necessary to withhold to maintain the effective
conduct of public affairs through the free and frank expression of
opinions by, between or to members of the University in the course of
their duty is withheld under section 9(2)(g))(i) of the OIA.
 4. Information that is necessary to withhold to enable the University to
carry on negotiations without prejudice or disadvantage is withheld
under section 9(2)(j) of the OIA.

 

You have the right to make a complaint to an Ombudsman if you are
dissatisfied with the University’s response.

This email is further to the University’s response of 23 April.

 

“1. Whether any money was spent by the University of Auckland in securing
the naming rights sponsorship of the North Stand at Eden Park.”

Yes, under the Icon Partnership Agreement, the University of Auckland pays
an annual partnership fee and provides a support fund to the Eden Park
Trust.

 

“2. If money was spent, the amount spent on the naming rights
sponsorship.”

The specific amount the University pays under the Icon Partnership
Agreement is confidential. However we can confirm that the amount
committed forms part of the University’s annual budget for marketing and
promotion expenses. It is necessary to withhold this information to
protect confidential information, to avoid unreasonable prejudice to the
University’s commercial position, and to allow the University to carry on
negotiations without prejudice or disadvantage. We recognise the public
interest in transparency and accountability in relation to University
expenditure in this area – this can be met through the disclosure of
annual total figures for the University’s expenditure on
advertising/sponsorship.

“3. Any documents or correspondence related to the financial arrangements
or agreements made between the University of Auckland and the Eden Park
Trust in relation to the naming rights sponsorship.”

Please see attached. Documents have been withheld for the following
reasons:

 

1.                  Information subject to an obligation of confidence is
withheld under section 9(2)(ba)(ii) of the OIA.

2.                  Information that, if disclosed, would be likely to
unreasonably prejudice the commercial position of the University of
Auckland or the Eden Park Trust is withheld under section 9(2)(b)(ii) of
the OIA.

3.                  Information that it is necessary to withhold to
maintain the effective conduct of public affairs through the free and
frank expression of opinions by, between or to members of the University
in the course of their duty is withheld under section 9(2)(g))(i) of the
OIA.

4.                  Information that is necessary to withhold to enable
the University to carry on negotiations without prejudice or disadvantage
is withheld under section 9(2)(j) of the OIA.

 

We recognise that there is a public interest in transparency and
accountability in relation to the content of the Icon Partnership
Agreement. This has been met by providing the attached document
summarising the benefits to the University under the Icon Partnership
Agreement entitled “Benefits of the Eden Park strategic partnership”.

 

You have the right to make a complaint to an Ombudsman if you are
dissatisfied with the University’s response.
