Conditions of clause 12a vaccination exemptions under the Vax Order

Erika Whittome made this Official Information request to Ministry of Health

Response to this request is long overdue. By law Ministry of Health should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Erika Whittome

Dear Ministry of Health,

I refer you to my previous OIA HNZ00023978 which states: "From 13 November 2021 to 26 September 2022, a total of 478 applications for Significant Service Disruption exemption (SSD) were received. 103 applications were granted, covering approximately 11,005 workers."

These were vaccination exemptions under Clause 12A of the Covid 19 Public Health Response (Vaccinations) Order 2021.

Subsequently my OIA HNZ00027972 has a response on the 29th Sept 2023 which states, "All those who received 12A exemptions per the previous response (ref. HNZ00029378) were in health-related work. "

Under clause 12a of the order, it says in (6):

The Minister may impose conditions on the exemption as the Minister considers necessary.

Would you kindly share details of ALL of these conditions that were imposed on these (approx) 11005 workers for their vaccination exemptions by the Minister? Please include all emails, correspondence, minutes and meeting notes related to these conditions as well.

Yours faithfully,

Erika Whittome

Kia ora,

The OIA team at Manatū Hauora is currently on holiday break. We will
return on 8 January 2024.

Please note, over the holiday period there are three weeks that don’t
count as ‘working days’. For Official Information Act (OIA) requests, that
period is 25 December 2023 to 14 January 2024 (inclusive). OIA requests
received after 27 November 2023 may take a bit longer than you expected.
If you'd like to calculate the timeframe, you can use the Ombudsman's
online calculator here: [1]http://www.ombudsman.parliament.nz/

Have a safe and happy holiday period.

Ngā mihi

Tēnā koe Erika,

Thank you for your email on 8 January 2024, asking for the following
information under the Official Information Act 1982 (the Act):

I refer you to my previous OIA HNZ00023978 which states: "From 13 November
2021 to 26 September 2022, a total of 478 applications for Significant
Service Disruption exemption (SSD) were received. 103 applications were
granted, covering approximately 11,005 workers."
These were vaccination exemptions under Clause 12A of the Covid 19 Public
Health response (Vaccinations) Order 2021.
Subsequently my OIA HNZ00027972 has a response on the 29th Sept 2023 which
states, "All those who received 12A exemptions per the previous response
(ref. HNZ00029378) were in health-related work. "
Under clause 12a of the order, it says in (6): The Minister may impose
conditions on the exemption as the Minister considers necessary.
Would you kindly share details of ALL of these conditions that were
imposed on these (approx) 11005 workers for their vaccination exemptions
by the Minister?
Please include all emails, correspondence, minutes and meeting notes
related to these conditions as well.
This email is to let you know that Te Whatu Ora needs more time to make a
decision on your request.

The Act requires that we advise you of our decision on your request no
later than 20 working days after the day we received your request.
Unfortunately, it will not be possible to meet that time limit and we are
therefore writing to notify you of an extension of the time to make our
decision, to 25 March 2024.

This extension is required because the request necessitates a search
through a large quantity of information and meeting the original time
limit would unreasonably interfere with the operations of Te Whatu
Ora such that a proper response cannot reasonably be made within the
original time limit.

How to get in touch
If you have any questions, you can contact us at [1][email address].

If you are not happy with this response, you have the right to make a
complaint to the Ombudsman. Information about how to do this is available
