I request all information including emails, meeting minutes, memos and recollections of discussions between Christopher Luxon, Winston Peters and David Seymor on the decision to appoint Shane Reti as Minister of Health. Specifically, I wish to know what was discussed of Mr Reti's pecuniary interests in Reti Holdings Limited, Whangarei Doctors Limited, and Primecare Kensington Services Limited.

Dear DPMC,
This extension is unlawful.
The transfer of the second half of the request, as you note, should have been transferred at the time. You have now exceeded the legislative requirement to do so promptly, and within 10 days as set out in Section 14.
Further, Section 15A is only applicable to the initial request made in accordance with Section 12. The extension cannot be applied to the act of transferring a request under Section 14. None of this request complies with Section 15A, and you have failed to provide information you are legislatively required to by Section 15A(2) - 15A(4).
This is completely unacceptable from DPMC.

I want some clarification on the response you have provided.
With regard to questions 1-3, can you please confirm that:
- your refusal under 9(2)(g) means that Minister Luxon has no written record nor recollection of a conversation with Minister Reti, Seymour or Peters regarding a conflict of interest in relation to Minister Reti's business interests.
- It is also believed that DPMC does not hold this information (as likely advised when transferred between departments).
To your point, the Ombudsman ruling is regarding the advice between the Cabinet Office and Ministers. As this request has been transferred to Minister Luxon's office in his capacity as party leader this judgement does not apply here. I will also note that this was last ruled on 12 years ago and I am sure you are aware that each request should be considered on a case-by-case basis rather than a blanket rule. This ruling also notes that a summary is appropriate, as an explanation of how risks plan to be mitigated.
Further to question 4, though you have advised that there is information in scope, you have not advised how many communications come into scope not the medium it was conveyed. This should have been provided to me as part of 'reasonable assistance'.
As I am requesting clarification to your response this should not be treated as a new request.

I can confirm that no information was held by the PM or this office at the date of your request.
You have indicated you believe the request was transferred to Rt Hon Luxon in his capacity as Party leader. This is not accurate as the OIA applies to Minister's and officials only and to the information they hold in this capacity.
