Dear Department of the Prime Minister and Cabinet,

Please can you share a list of all cabinet papers or briefings from across agencies which have not been proactively released in the last 12 months of this government, and the reasoning for not releasing. I am not interested in those papers which arent released because of defence / security reasons, but interested in papers which were not released for other reasons (choice / timing etc.)

Ideally the list will include: Paper title (and short descriptor if not decipherable from the title), Agency, Date, Reason for not being released proactively.

Thank you for your request received under the Official Information Act (the Act) on 14 September 2023.

I am emailing to clarify the scope of your request because of the large volume of potentially relevant information within scope. I also note that the Department of the Prime Minister and Cabinet (DPMC) is not responsible for the publication of all Cabinet papers or briefing documents; these are typically published by the relevant Minister via their responsible agency.

As at 14 September 2023, we hold information relating to the proactive release of Cabinet papers and briefing documents for the Prime Minister as DPMC’s Responsible Minister, and the five portfolio Ministers we provide services to covering seven portfolios.

We consider that your request is substantial in nature and is likely to be refused under 18(f) of the Act as the information requested cannot be made available without substantial collation or research. To fulfil your request, requires DPMC identifying documents within scope of your request and determining whether they have been proactively released, for the Prime Minister and five Ministers spanning seven portfolios covering a 12-month period, which we consider is substantial in scope. Your time frame of 12 months captures additional ministers and portfolios.

We suggest that the request is refined to include a list of Cabinet papers prepared by DPMC for the current Prime Minister that have not been proactively released. For the current Prime Minister this covers the timeframe from 25 January – 14 September 2023.

Regarding the part of your request for information held by other agencies, you may wish to consider making a request direct to that agency (if you have not done so already). Details on other government agencies are available on the following website:
