Disposal of land policy and legalities

Response to this request is long overdue. By law Ruapehu District Council should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

Dear Ruapehu District Council,

Please confirm any policies for land disposal.

1./ Did council take out a valuation of Tietie drive as per section 59 of the LGA, if so please provide a copy.
2./ Who made the decision that the policy of significance was not triggered and under what conditions, please provide evidence.
3./ Council (Clive CEO) advised on 31st August that he disagreed that council have not triggered their policy of significance. Do council still believe after 31st August meeting of the community, that the policy of significance is not triggered.
4./ Did council confirm this land is not required for operational purposes
5./ Did council consider no risk to council output is anticipated as a result of this potential sale
6./ Did council declare the land surplus to requirements and if so when
7./ Is this transaction taking place under Section 50 of the Public Works Act, if so please provide documentation signed by the minister and agreements
8./ When was the last offer for purchase of the land and at what price.
9./ Council was advised that Carrot Park Trust wishes to purchase the land, please put on hold any possible land sale and make contact to see which offer is in the best interest of rate payers.

Please also see https://oag.parliament.nz/2005/copy_of_2... for legal requirements for council to sell land assets. Council has confirmed in a recent public meeting, that consultation on the land use/sale has not been discussed until now.

Dear Info,

This OIA is yet to be responded to, it was submitted to you on 5th September and acknowledged on 8th September with a due date of 3rd October being 20 working days.

Since then we have not received a single response from council and we have followed up multiple times:
4th October
11th October
24th October
15th March
And again today.

The questions asked were as follows:

1./ Did council take out a valuation of Tietie drive as per section 59 of the LGA, if so please provide a copy.
