We have finished collating the documents you requested and are currently carrying out the internal consultations necessary to make a decision on your request.

Unfortunately, as Police's decision was due to you yesterday, it is no longer possible to extend the time limit to complete these consultations. I acknowledge this means Police has failed to meet it statutory obligation under the OIA, and I apologise wholeheartedly for that error.

I see NZ Police has marked many sections as having been redacted under "s 9(2)(g)". However, as mentioned in their response letter, section 9(2)(g) of the OIA does not describe a single reason for withholding information. Rather, it has two sub-sections which provide quite different justifications for withholding information: https://www.legislation.govt.nz/act/publ...

"[the withholding of the information is necessary to] maintain the effective conduct of public affairs through—
(i) the free and frank expression of opinions by or between or to Ministers of the Crown or members of an organisation or officers and employees of any public service agency or organisation in the course of their duty; or
(ii) the protection of such Ministers, members of organisations, officers, and employees from improper pressure or harassment;"

Under section 19(a)(i) of the OIA, when refusing to release requested information, NZ Police have an obligation to provide "the reason for its refusal". Typically, this means providing the specific reason under the OIA, not a group of reasons without specifying which apply.

This decision by NZ Police to not be specific in which reasons they have relied on may make it more difficult for you if you decide to complain to the Office of the Ombudsman about their repsonse. If you intend to do this, you may first wish to ask NZ Police for the specific reasons why each piece of information was withheld and, as you are entitled to under s19(a)(ii) of the OIA, for the grounds in support of that reason.

This is a great OIA, but it appears to be overzealously redacted (see page 20 in [S.I IR 01 23 28468 response documentation Redacted.pdf] !)
