Dear Health New Zealand,

I have been unable to locate any statutory reference to Te whatu Ora

By way of Oia please advise if this is

1. the maori name for Health New Zealand

2. how " official" is this name given that it has no statutory recognition or interpretation of the name and therfore it has no legal standing e.g. can te whatu ora make a demand for payment

3. what implied official/ statutory recognition does the name have if so by virtue of which enactment

4.there is a requirement for transparency in our laws yet this undefined name has become responsible for establishing to running the health system across New Zealand (https://www.futureofhealth.govt.nz/healt...) . where does one find te whatu ora and where does it get its powers from how do we get accountability from it

5. Is there is a legitimate reason for it to be called te whatu Ora if so why was this not reflected in statute

6. who assigned this name and how was this name attributed to a statutory body which did not exist prior to 1 July 2022

7. if Health New Zealand was to be known by any other name why was it not reflected in statute

please provide all docuemntation which discus and consider the above points

thank you for your response

I note that the healthy futures act specifically sets up a Maori Health Authority
which has now been called Te Aka Whai Ora which reports its role as " Leading and monitoring transformational change for the hauora health and wellbeing needs of whānau Māori"

The legislation also sets up Health New Zealand presumably this is for all who do not identify as Maori , the being majority of our population .

As with many of my generation educated and raised in New zealnd we did not learn Maori . Many of us come from other cultures where it is impolite and culturally insensitive to use language which is not common to the people present .

If Maori have their own seperate health system why then is it necessary for non moiri to have to identify with language which is foreign to to them and not part of the culture we were raised in .( in particular we live in NZ we have not moved cluture has changed around us by stealth )

The legislation specifically creates two health providers health NZ and the maori health authority they are two seperate legal entities and have a disputes process set in legislation

I note that Te whatu Ora is not a registered trade name and with so many scams why do we have a legitimate organisation using a false name in a language which is unfamiliar to the majority of the population .

Those who identify as Maori including those who are 99.5 % genetically non maori have a choice and can take advantage of both providers

By way of OIA please advise
1. how it is determined if some one comes under the Maori Health authority or health New Zealand .

2. the funding for each respective authority for every year since 2022 and budgeted in the next 5 years

3. the consideration to providing the english name to health New zealand since the services it provides is not targeted at Maori

4.please provide the policy for both health New zealand and the maori health authority as to their operation conduct and ownership and use of of public assets and infrastructure

5. while I agree with respect to the use of trading names it has to be noted that te Whatu ora is not registerd as a trading name and as such is just simply a name derived without any legitimacy or authority and enforced on the non maori speeking majority of New Zealanders ..while I accept that Maori have their cultural rights the rest of us have those rights too and perhaps we all need to start calling on our ancesstry to identify ourselves this way we can be certain that we set up cultural bias rather than being one unified melting pot .what consideration was given to the legitimisation of the name .

6 please provide documentation to show that the cultural sensitivities of non maori were ever considered and if not why not .

7. As the name te Whatu Ora did not exist as a name at the time the legislation passed into law , it cannot be a traditonal name and appears to be a made up name assigned as a synonym please provide evidence of consultation to the public that Health New Zealand was intended to serve ( non maori) when deciding on an alternative to the legal name and receiving feed back as to their comprehension with regards to the name

8. please provide copies of all due dilligence that has been done with regards to the implications of asigning a non legal name to a public authority with emphasis on potential for fraud by the introduction of other non defined non legal names. this particulary affects the ability of non legal epersons to own property I note that Te whatu Ora is recorded as owning property which is an impossibility due to its non legal status .

9 In stating that Te whatu Ora did not exist when the law was drafted , please proivide the documetnation and consent which was obtained in assigning the name
