Renaming the Ministry

Luke made this Official Information request to Ministry of Justice

Response to this request is long overdue. By law Ministry of Justice should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Luke

Dear Ministry of Justice,

Does the Ministry of Justice intend to redesign its branding, logo or advertising and change its English name from "Ministry of Justice" to "Te Tahu o Te Ture | Ministry of Justice" in line with other government departments?

Does the Ministry intend to adopt a new bilingual name? If so, will the Ministry be encouraged to refer to the agency by its Maori name only (similar to "Waka Kotahi" or "Te Whatau Ora")?

Will the Ministry adopt a new web address and replace justice.govt.nz with a redirect URL?

Please release all relevant email correspondence between the Ministry of Justice and the Chief Operating Officer, Secretary for Justice, Kiri Allan, Rino Tirikatene, Public Service Commissioner, Minister for the Public Service and the Department of Prime Minister and Cabinet regarding renaming the Ministry of Justice.

Please release all relevant email correspondence between the above mentioned persons, and also the Judicial Committees and Chief Justice regarding renaming the Courts and Tribunals.

Please also release any relevant advice for renaming the Courts and the Ministry of Justice.

Yours faithfully,

Luke

Dear Easton, Paul,

Q7:
As you are aware, Cabinet has decided that all government departments are required to develop a Māori Language Plan by 30 June 2021. See CAB MCR-18-MIN-0012 for more detail.

Can you confirm that at no point has the Ministry of Justice, the COO, the Secretary for Justice, the DMPC nor any other person I mentioned in my prior email considered the need to update the Ministry of Justice's name in light of Cabinet requirements?

If they have, then I require you to review your answers to questions 4-6 of my prior request.

Q8:
When did the Ministry start using "Te Tahu o te Ture" interchangeably with the "Ministry of Justice"? How did this happen without any email directions from senior officials at the Ministry?

Q9:
Regarding question 5, I did not ask for plans to rename the courts in the future. I asked for email correspondence on renaming the courts and tribunals. As you mention, some courts have started using te reo names on their websites, such as "Te Koti Mana Nui" for the Supreme Court. Almost certainly, that was made with directions from either the Ministry of Justice or Court officials.

Likewise, in early 2023, the Tenancy Tribunal started referring to Auckland, Wellington and Napier (along with others) tribunal locations as "Auckland | Tamaki Makaurau" etc. Almost certainly, that too was made with directions from either the Ministry of Justice or Court officials.

So again, I ask for email correspondence, not plans.

Q10:
If any OIA request from questions 1-9 were to be refused, then please also give the grounds in support of its refusal.

Yours sincerely,

Luke

Dear [email address],

Please be advised that you are required under section 19(a)(ii) of the Official Information Act 1982 to provide the grounds for refusal if an applicant requests.

I have requested this at Q10, and note that the Ministry is under a legal duty to comply.

Further, you have not provided a reason for refusing questions 7-10, even though they are materially different from questions 1-6. Again, you are under a duty to comply, this time with section 19(a)(i).

Yours sincerely,

Luke
