From: Jay
Hello
I'm emailing in response to OIA23-0243.
I'm not entirely sure what has happened with this request.
- I made the request on 26 April to the office of Hon Damien O'Connor and received an acknowledgement from the Minister's office on 3 May.
- On 12 May I then got a contradictory response from MPI stating the request was being transferred "in full" to the office of Hon Damien O'Connor (despite this being who the request originally went too) but with the letter then stating the request was "partially being transferred". I would note, at no point did I receive notice of transfer from Hon Damien O'Connor to MPI— rather this a letter on MPI letterhead.
- On 19 May I then received another letter stating my OIA was being transferred: "This letter is to advise you that MPI is transferring your request in full to the office of Hon Damien O’Connor, Minister for Biosecurity, under section 14(b)(ii) of the Official Information Act 1982."
As per my original request on 26 April, this was made directly to the Office of Hon Damien O'Connor and was never made to MPI. As such, the request should not be transferred from Minister O'Connor to MPI and then back to the Minister.
Further— under the OIA, transfers must occur within 10 working days.
Therefore, as per my original request on 26 April 2023 to the Minister, I request that this be answered as per the statutory time frame which would be Wednesday 24 May 2023.
Regards
Jay
