I refer to your request under the Official Information Act 1982 (the OIA)
received on 13 December 2022 requesting the following information from
Immigration New Zealand:

 

“Since January 1^st 2020, how many people are still waiting to be deported
after being served a initial deportation notice at least 2 or more years
ago and have a drug conviction and minimum sentence of 5 years or
greater?”.

 

INZ does not capture the specific offence a person is convicted of and the
sentence imposed when they become liable for deportation and are served a
deportation order, therefore your request is likely to refused under
section 18(e) of the Act as the information requested does not exist.

 

This decision has not yet been made, and we would like to consult with you
about rescoping your request before doing so. We are able to provide
general data and suggest rescoping your request to ‘since 1 January 2020,
the number of people served a deportation order who have yet to be
deported, having been served that deportation order at least two years
ago’.

 

Can you please respond by Wednesday 4 January 2023 and confirm if you
agree to the proposed wording. If we do not receive a response by this
date we will proceed without rescoping.
