JB made this Official Information request to University of Otago
The request was successful.
From: JB
Dear University of Otago,
I am making an OIA request for a spreadsheet or document containing confirmed grades of all students taking the following specific Law and Commerce papers in semester 1 2022. This need not contain further data other than their overall grades.
To clarify, I am asking for the specific grade percentage, not merely the grade letter.
The papers I am requesting are:
LAWS413 - Labour Law
LAWS407 - Company Law
LAWS437 - Competition Law
ACTP311 - Auditing Practice
Yours faithfully,
JB

I refer to your information request dated 1 July 2022 made under the
Official Information Act 1982 (Act). You have requested mark and grade
distributions for the ACTP311, LAWS407, LAWS413 and LAWS437 papers for
Semester 1 2022.
We have decided to grant your request, subject to the following comments.
o Please find attached the mark and grade distributions for ACTP311 and
LAWS437. We note that the mark distributions for LAWS407 and LAWS413
have not been finalised yet as there may be special examinations
outstanding and grades for some students have not been finalised. We
are not comfortable releasing the data before all grades have been
confirmed – as this may affect students’ wellbeing and disrupt
students’ performance in special examinations. We will release the
mark and grade distributions for LAWS407 and LAWS413 once the marks
have been finalised – we anticipate that these will be confirmed over
the coming weeks.
o In the attached mark distributions for ACTP311 and LAWS437, we note
that students who withdrew from these papers are not included in the
data.
o Please note that for privacy and student wellbeing reasons, we
determine that it is necessary to not report on fail marks where there
are fewer than 5 students who failed a particular paper. Where the
numbers are very low, there is a risk that the identity of these
students could be determined/inferred, and that their personal
information (i.e. their marks) could be revealed. We note that where
there are fewer than 5 students who have failed a paper, we will group
these students together and withhold their mark scores – this is to
protect the privacy and wellbeing of these students pursuant to
section 9(2)(a) of the Act. This is not relevant for the information
we have provided you in this email, however it may be relevant for the
information we provide once the mark distributions for the remaining
papers are available.
We will be in touch with regards to the remaining information once the
mark distributions for LAWS407 and LAWS413 have been confirmed and are
available.
If you are not satisfied with our response to your information request,
section 28(3) of the Act provides you with the right to ask an Ombudsman
to investigate and review this response. However, we would welcome the
opportunity to discuss any concerns with you first.

Dear UoO - Official Information Act,
I note that another request has been fulfilled with the grade distributions for these papers - can you provide an explanation for this please?
Yours sincerely,

Thank you for your email and for your patience while I looked into this for you.
Unfortunately the grade distributions for LAWS407 and LAWS413 were inadvertently released before all final grades for these papers had been confirmed. It is the University's standard practice to not release grade distributions of papers until all student grades have been confirmed.
I apologise for any confusion this may have caused. Once the final grade distributions for LAWS407 and LAWS413 have been confirmed I will release these to you.

Thank you for your patience. Following our email of 29 July 2022, and
subject to the following comments, please see attached the mark and grade
distributions for the LAWS407 and LAWS413 papers for Semester 1 2022.
o Students who withdrew from the papers are not included in the data.
o Given that only three students failed LAWS407 (i.e. received a grade
of FD or FE), we have determined that it is necessary to withhold the
marks and specific grades for these students to protect their privacy
and wellbeing. This is consistent with section 9(2)(a) of the Act. We
consider that withholding this information is necessary to protect
against the identity of these students being determined or inferred,
and their personal information (i.e. their marks) could be disclosed.
We consider that good reasons exist for withholding this information
and this is not outweighed by other considerations which would make it
desirable, in the public interest, to make the information available.
If you are not satisfied with our response to your information request,
section 28(3) of the Act provides you with the right to ask an Ombudsman
to investigate and review this response. However, we would welcome the
opportunity to discuss any concerns with you first.
