Dear Radio New Zealand Limited,

In Phil Pennington's article 'FENZ identifies various faults in hospitals' fire safety design', dated 14 February 2022 (https://www.rnz.co.nz/news/national/4614...), the following information is requested:

A1. Where the article states: "More formalised rules covering fire designs on most commercial buildings were scrapped for hospitals in 2017 because they weren't working", under s 29(2) of the Building Act 2004, the chief executive must publicly notify proposed changes to Acceptable Solutions or a Verification Method, which includes public notification of the proposed change in the New Zealand Gazette. Provide the 2017 New Zealand Gazette notification number for the (at the time) proposed changes (pursuant to section 29 of the Building Act 2004) that later resulted in the rules being 'scrapped' for hospitals that RNZ (or any of its agents) relied upon for this statement in the article.

A2. For the FENZ review of 45 hospital designs published on the RNZ website (above), provide the number of FENZ ICAD reports provided by FENZ to RNZ (or any of its agents) to date (i.e., as of 27 February 2022) which validate any of FENZ' comments regarding FENZ' reviews of the 45 hospital designs (please note: there should be over 5,000 healthcare structural fires since 1994 that FENZ have responded to and are on FENZ' internal records).

A3. For the FENZ review of 45 hospital designs published on the RNZ website (above), provide the number of Worksafe, coroner's findings, or judiciary findings (i.e., District Court or above) provided (or referenced) by FENZ to RNZ (or any of its agents) to date (i.e., as of 27 February 2022) which validate any of FENZ' comments regarding their reviews of the 45 hospital designs (there have been over 5,000 healthcare structural fires since 1994 that FENZ have responded to).

In Phil Pennington's article 'MBIE officials meet with Auckland Council over delays to hospital building consents', dated 1 December 2021 (https://www.rnz.co.nz/news/national/4569...), the following information is requested:

B1. Where the article states: "District Health Boards have also asked the Ministry of Health for help. The ministry has not yet responded to RNZ's questions.", provide these questions RNZ has put to the Ministry of Health and any response.

In Phil Pennington's article 'Auckland hospital projects delayed by fire concerns', dated 30 November 2021 (https://www.rnz.co.nz/news/national/4568...), the following information is requested:

C1. Where the article states: "At the same webinar, FENZ' lead fire engineer Etienne Hermouet cited three recent smouldering fires in care homes - two in 2019, one last year - too small to set off sprinklers but that exposed residents and staff to smoke inhalation nonetheless.", provide the FENZ ICAD reports received by RNZ (or any of its agents) for these fire events, as of 27 February 2022.

C2. Where the article states: "At the same webinar, FENZ's lead fire engineer Etienne Hermouet cited three recent smouldering fires in care homes - two in 2019, one last year - too small to set off sprinklers but that exposed residents and staff to smoke inhalation nonetheless.", provide all of the Worksafe, coroner's findings, or judiciary findings (i.e., District Court or above) for these fires that FENZ provided to RNZ (or any of its agents) to date (i.e., as of 27 February 2022) for these three fire events.

Note: For clarity, for questions A2, A3, C1, and C2, where FENZ has not provided any information to RNZ (or its agents), this OIA request does not require RNZ to further seek this information from FENZ, or forward this OIA to FENZ.
