Thank you for contacting Hon Grant Robertson, Deputy Prime Minister, the
Minister of Finance, Minister for Infrastructure, Minister for Sport and
Recreation, Minister for Racing and MP for Wellington Central.

The Minister considers all correspondence important and appreciates you
taking the time to write. As Minister Robertson receives a large amount of

where appropriate

Invitations and requests to meet with the Minister will be processed as
soon as possible and a staff member will be in contact with you in due
course

Media queries will be responded to by a staff member.

Requests for official information will be managed in accordance with the
provisions of the Official Information Act 1982, which may include
transfer to a more relevant Minister or agency.

If your correspondence is to the Minister as the Member of Parliament for
Wellington Central, this will be referred to his electorate office.

If your email falls outside of the Minister’s portfolio responsibilities,
expresses a personal view, or is copied to multiple Members of Parliament,
then your opinion will be noted and your correspondence may be transferred
to another office, or there may be no further response to you.

 

Please note information about meetings related to the Ministers’
portfolios will be proactively released (this does not include personal or
constituency matters). For each meeting in scope, the summary would list:
date, time (start and finish), brief description, location, who the
meeting was with, and the portfolio. If you attend a meeting with the
Minister on behalf of an organisation, the name of the organisation will
be released. If you are a senior staff member at an organisation, or meet
with the Minister in your personal capacity, your name may also be
released. The location of the meeting will be released, unless it is a
private residence. The proactive release will be consistent with the
provisions in the Official Information Act, including privacy
considerations. Under the Privacy Act 1993 you have the right to ask for a
copy of any personal information we hold about you, and to ask for it to
be corrected if you think it is wrong. If you’d like to ask for a copy of
your information, or to have it corrected, or are concerned about the
release of your information in the meeting disclosure, please contact the

The Treasury was asked by the Minister of Finance’s Office to assist in
drafting a reply to an OIA request you submitted on 8 November 2021,
copied below.

 

all information you hold in a ministerial or deputy prime ministerial
capacity regarding the definition or use of the term "social licence".

 

Your request, as currently framed, lacks due particularity as required by
12(2) of Official Information Act as it does not include a timeframe for
the information being sought, the type of information requested is not
stated and no particular topics or areas have been provided (e.g ‘social
license in regard to housing, or wage subsidy’).

 

Due to the lack of due particularity and broad scope of your request, it
is likely to be refused under section 18(f) of the Official Information
Act as substantial manual collation would be required to provide the
information requested.

 

As such, I would like to suggest refining your request, so we are able to
make the proper considerations on the information you are seeking. I
recommend refining your request, for example by requesting:

 

o all official documents held in a ministerial or deputy prime
ministerial capacity regarding the definition or use of the term
"social licence” for housing for the last 6 months.

 

Please note that once you have amended or clarified your request, under
section 15(1AA) of the Official Information Act, the Ministry may treat
your amended or clarified request as a new request that replaces the
original request. This may lead to a new start of the statutory response
period.

May I clarify that I was asking specifically requesting information specifically about the definition or use of the TERM "social licence", not for e.g., all documents using this term or concept.

For that reason it's hard for me to refine the request without changing its subject.

So... does the Minister then not have a working definition for the term "Social licence"? Or did he just not consider writing it down?

The Ombudsman's guide to section 18(e) of the OIA makes it clear that information held in the minds of employees (and ministers) in their official capacity but has not yet been reduced to writing is official information, and should be considered for release when it is requested.

This includes... Information held in the minds of employees that has not yet been reduced to writing. Obviously, the more recent the information, the more likely it can be recalled. On request, any unrecorded information should be reduced to writing and released, unless there is a good reason for withholding. Reducing unrecorded information to writing does not amount to the creation of new information. Rather, it is the provision of existing information in a different form."
