Pathway to New Resident visa for temporary visa holder who left Trans-Tasman due to visa restriction

Sonu Ramtirth Pival made this Official Information request to Kris Faafoi

This request has had an unusual response, and requires attention from the FYI team.

From: Sonu Ramtirth Pival

Dear Kris Faafoi,

I the undersigned Mr. Sonu Pival (ME in Electrical & Electronics graduated at AUT university) an Indian citizen holding an open post study temporary visa with client no - 66183431.

Travel bubble between Australia & NZ was initiated on Oct' 20 till Jan'21.So, I departed on 15th Dec '20 & landed in Melbourne quarantine free. But due to delta outspread NZ borders were closed immediately without any intimation & I was stuck in Australia for 3months. I thought nz border's will open soon as my visa had restrictions which didn't allowed me to stay longer in Australia. I'd booked MIQ slot (authentication number 7b5e7ed3-d9f7-46a3-9782-23af80eb66c5) on 15th march but due to border closure, I'd to cancel that too and left no choice but to return back to my home country India.

I wanted to confirm whether I would be eligible for New resident visa 2021 because I'd travelled during trans-tasman travel bubble and tried my best to reach out authorities back in nz to assist me but my questions were unanswered and in constant fear & suppression planned to return back my home country. I really want to get back to my work & help nz economy to grow.

Through your platform I would like to request immigration nz to please consider my application for new resident visa 2021. Also, I'm really grateful that you have put your time aside to check this request.

Thanking you in advance,

Yours faithfully,
Sonu.

Dear Sonu,

The 2021 Resident Visa provides a one-off, simplified pathway to residence
for around 165,000 migrants currently in New Zealand.

The 2021 Resident Visa recognises the commitment and important
contribution these people have made to New Zealand during COVID-19

To be eligible for the 2021 Resident Visa, the primary applicant must be
in New Zealand. Temporary visa holders who left New Zealand are generally
not eligible for this one-off residence pathway, unless you fall into the
following two groups:

1.       Critical health workers for longer term roles (6 months or
longer) or another critical worker for long term roles (more than 6
months) who arrive in New Zealand and apply before 31 July 2022

2.       If you meet the criteria for eligibility but are in Australia and
have been unable to return to New Zealand by 29 September 2021, you may be
considered eligible.

More information about the eligibility criteria for the 2021 Resident Visa
is available on [1]Immigration New Zealand’s website.

Kind Regards,

Office of Hon Kris Faafoi

Minister of Justice, Minister for Broadcasting and Media, Minister of
Immigration
