Dear Mr Cresar

Thank you for your email. You are correct that my Office is not subject to the Official Information Act 1982 and neither is the House of Representatives, on behalf of which I hold the records of select committees. However, all select committee papers (except secret evidence and draft reports) become publicly available once the committee reports to the House. Since your petition has been reported to the House, I will provide you with any documents it held in relation to the petition. I will send these to you by early next week.

Regards

David Wilson (he/him)

Dear Mr Creser

Attached are the minutes of the Justice Committee meeting and Justice subcommittee meeting at which your petition was considered. Information that is confidential to the committee about other business has been redacted. The only other information received was the email that you sent to the committee about your petition, which you will already have.

Yours sincerely

Dear David Wilson,

Thank you for the minutes for petition 87699. I note from the minutes dated 1 April 2021 that the committee at part 15.1 instructed the secretariat to draft a pro forma report.

Can you please forward that report.

In respect of the minutes dated 12 August 2021 at part 3.1 the papers tabled are the draft report and my email requesting the assistance of the committee to obtain evidence.

Could you please advise why none of the evidence I collected independently from the Justice Department, the Ombudsman, the Privacy Commissioner, the Law Society or Chief Archivist was tabled despite being emailed to both the secretariat and committee members individually.

I now understand the hearing took place on 12 August 2021, therefore request your advice as to why I was not notified or given an opportunity to respond to the draft report from this date which I have yet to see.

Yours sincerely,

John Creser
