Building NBS activity

Justin Sherper made this Official Information request to Ministry of Social Development

The request was refused by Ministry of Social Development.

From: Justin Sherper

Dear Ministry of Social Development,

Kia Ora,

With the recent issues identified in Wellington with the Asteron building occupied by Inland Revenue, I’m seeking information on the Policies, Process and documents held by larger government agencies relating to leased and owned buildings surrounding building quality and Asset Management.

Could you please provide:

• Any policies or practices that MSD use to check NBS or equivalent when signing new leases or retrospectively?
• A list of MSD leased sites
o when the lease was last re-negotiated or signed?
o if MSD has a record of the NBS ,DSA or other documentation
o What the NBS or equivalent is?
o What plans are in place if the NBS percentage or Seismic Assessment is less than what MSD deems acceptable?
• A list of MSD owned buildings
o What is the NBS of the buildings?

Thank you

Yours faithfully,

Justin Sherper

Tçnâ koe Justin Sherper,

Thank you for your email received 11 August 2021, under the Official
Information Act 1982. Your request has been forwarded to the appropriate
officials at National Office to respond. You can expect a decision as soon
as reasonably practicable, and in any case not later than 20 working days
after the day on which the request was received.

The information you have requested will likely contain Ministry employee
names and contact details. We need to consult relevant Ministry employees
before deciding whether we can release this information to you, and this
will take additional time and effort.

If you do not need the names of Ministry employees who are below tier 4
and/or who are not decision-makers, please advise us as soon as possible
and we will treat your request as amended accordingly.

In any event, the Ministry will make and communicate to you a decision on
your request as soon as reasonably practicable, and within the statutory
maximum time limits – including the extension of time limits (Section 15A
of the Act).

Tēnā koe Justin Sherper

On 11 August 2021, you emailed the Ministry of Social Development (the Ministry) requesting, under the Official Information Act 1982, the following information:

Could you please provide:

• Any policies or practices that MSD use to check NBS or equivalent when signing new leases or retrospectively?
• A list of MSD leased sites
o when the lease was last re-negotiated or signed?
o if MSD has a record of the NBS ,DSA or other documentation
o What the NBS or equivalent is?
o What plans are in place if the NBS percentage or Seismic Assessment is less than what MSD deems acceptable?
• A list of MSD owned buildings
o What is the NBS of the buildings?

This letter is to advise you that the Ministry requires more time to respond to this request. In accordance with section 15(1) and 15A of the Official Information Act, the Ministry’s decision will be with you no later than 29 September 2021.

The reason for the extension is that consultations necessary to make a decision on the request are such that a proper response to the request cannot reasonably be made within the original time limit.

The Ministry is focussing its resources on supporting New Zealanders through COVID-19 by administering welfare support during this unprecedented time. Resources within our business units, where information for Official Information Act requests is drawn from, is limited or unavailable as the normal functions of business units have been temporarily suspended to aid in the Ministry’s COVID-19 response. Staff have also been redeployed to assist the frontline with the processing of welfare payments. As such, there may be a delay in you receiving a response from the Ministry. Thank you for your patience and understanding during this time.

You have the right to seek an investigation and review by the Ombudsman of this decision. Information about how to make a complaint is available at www.ombudsman.parliament.nz or 0800 802 602.

If you wish to discuss any aspect of your request with us, including this decision, please feel free to contact [MSD request email]
I will respond to you sooner if I am able to.
