Dear Opotiki District Council,
I am seeking a copy of the communication Michael Homan received from solicitors Cooney, Lees & Morgan regarding an easement over Lot 66 at Whanarua Bay. This was in August 2019. Below is an extract from an email communication;
I have received feedback from Cooney Lees Morgan regarding the original easement including our proposed changes, in particular those we discussed concerning Clause 10. Their feedback was comprehensive but effectively recommended that due to changes in legislation since the previous draft that they propose a completely new easement in a much better format than the original be prepared. I have not at this stage instructed them to prepare such.
Since receiving the feedback from Cooney Lees Morgan I have been asked to cease progressing the easement to allow discussions with Te Whānau a Apanui to continue. Although I am not privy to those discussions I have been informed that this will only take a matter of months.
I would also like a copy of the proposed changes mentioned above and a draft of the proposed easement.
