OIA Request: Custodial Practice Manual 2021

In July 2016, I requested the Department of Corrections release the Custodial Practice Manual in full (ref C78594). Initially, my request was refused under section 6(c) of the OIA, but following a complaint with the Ombudsman the Department of Corrections made a redacted copy of the Custodial Practice Manual available on their website in August 2017: https://www.corrections.govt.nz/resource...

I don’t believe this document has been updated since it was first prepared. Based on the description on the Department of Corrections website, I believe it was up to date as at 23 May 2017. However, there may have been updates to the Custodial Practice Manual since then.

Please release the following information:

1. Is the redacted copy of the Custodial Practice Manual available on the Department of Corrections website up to date?

2. If the redacted copy of the Custodial Practice Manual available on the Department of Corrections website is not up to date, please release an updated copy of the Custodial Practice Manual.

Please provide this information in an accessible, searchable format.

The current copy of the Custodial Practice Manual on the Department of Corrections website is only partly accessible, with a large portion of the PDF being images of text that are not accessible. If an updated copy is provided as per part 2 of my request, please ensure it is provided in an accessible, searchable format.

I've annotated my request as partially complete because Corrections answered part 1 of my request (the Custodial Practice Manual is not up to date) but appears to have refused part 2 of my request under section 18(d) of the OIA, though unfortunately they have not cited this section or explicitly stated that they have refused this part of my request.

However, they have not provided an updated copy of the Custodial Practice Manual as I requested, and have instead said that " A current version of the Custodial Practice Manual will be available on Corrections’ website by the end of March 2021."

I understand that I would likely have grounds to complain to the Office of the Ombudsman on the basis that the decision to update the copy of the Custodial Practice Manual on the Corrections website was unlikely to have been made before Corrections received my request, and therefore they would not be justified in refusing it under section 18(d).

However, given Corrections has undertaken to release this information on their website relatively soon, I think this end still serves the purpose of my request. So unless this update is not completed by the end of March, I don't expect I will complain.

Alternately, I suppose Corrections could argue that they have communicated their decision to release the information I have requested, and their "by the end of March 2021" is just their making that information available "without undue delay". That seems like a more charitable, and more reasonable interpretation of their response, though I can't say I'm a fan of this approach in general.
