Thank you for your information request received 4 March 2020, under the
Local Government Official Information and Meetings Act 1987 (LGOIMA).

 

Your requested asked for:

Council has considered your request and advises that it is not possible to
answer this request as it is worded.  Council believes your current
request involves thousands of emails and numerous files which will involve
substantial research and collation and our Council does not have the
resources available to do this.  The impact on the Council’s operations
would be severely disruptive.

 

Council has considered whether to fix a charge under section 13 of the
LGOIMA, or whether an extension under section 14 of the LGOIMA would help
with the substantial collation and research.  However Council still
believes the impact on the Council’s operations would be severely
disruptive.

 

Therefore, Council has decided to refuse your request as it stands. This
decision is made under section 17(f) of the LGOIMA, as the information
requested cannot be made available without substantial collation or
research.

 

You may wish to refine the scope of the request and this would need to be
quite specific as to what you are requiring.  If you would like to discuss
ways to do this please call me on 094391174.

 

Under section 27 you have the right to seek a review or investigation by
the Ombudsman regarding Council’s decision to refuse your request as it

Thank you for your clarification.  Our team have advised this is more
achievable, however it will still involve the research and collation of
several hundred emails, possibly in the early thousands.

 

While the disruption on Council activities is much less in this new form
we believe a charge will still apply.   We are guessing this will require
at least an hour’s work from possibly 12-15 staff members and
consultants.  Council uses the Ministry of Justice’s guidelines when
charging for LGOIMA requests.  Our estimate for the time taken is 14 hours
at $76.00 per hour totaling $1,064.00.  If you would like to proceed with
your request please can you let me know and I will arrange for an invoice
to be sent to you.  If the information can be gathered within a lesser
timeframe I will arrange for a refund on any charges paid.

 

Under section 27 of LGOIMA you have the right to seek a review or
investigation by  the Ombudsman regarding Council’s decision to charge a
fee in order to respond to your request.

Hi Ryan

 

Further to your information request please find attached documentation
relating to the Dargaville Pontoon under the Local Government Official
Information and Meetings Act.

 

The names and contact details of some external parties have been redacted
under section 7(2)(a) of the Act to protect the privacy of natural
persons.  Also the agreements have been withheld under section 7(2)(i) due
to commercial sensitivity.  I have considered the wider public interest in
withholding the information and believe that is not outweighed by the
commercial sensitivity.  It is possible that in the future the final
agreement will be publicly available. 

 

Going through this information has taken some time so I apologise for some
double up’s of emails.

with the Minister’s office regarding the Dargaville pontoon upgrade in

Thank you for your clarification. Our team have advised this is more
achievable, however it will still involve the research and collation of
several hundred emails, possibly in the early thousands.

 

 

 

While the disruption on Council activities is much less in this new form

we believe a charge will still apply. We are guessing this will require

at least an hour’s work from possibly 12-15 staff members and consultants.
Council uses the Ministry of Justice’s guidelines when charging for LGOIMA
requests. Our estimate for the time taken is 14 hours at $76.00 per hour
totaling $1,064.00. If you would like to proceed with your request please
can you let me know and I will arrange for an invoice to be sent to you.
If the information can be gathered within a lesser timeframe I will
arrange for a refund on any charges paid.

 

 

 

Under section 27 of LGOIMA you have the right to seek a review or
investigation by the Ombudsman regarding Council’s decision to charge a
fee in order to respond to your request.
