Kia ora Sam,
The property at 9 Central Terrace, Wellington is held in the Treaty
Settlements Landbank (the Landbank) for Treaty settlement purposes with
iwi in the Wellington region. The Landbank property portfolio is managed
by Land Information New Zealand (LINZ).
It had been identified for redress with Taranaki Whânui ki Te Upoko o Te
Ika in terms of their settlement with the Crown under the Port Nicholson
Block (Taranaki Whânui ki Te Upoko o Te Ika) Claims Settlement Act 2009.
The iwi however elected not to purchase this property under the deferred
selection process but it is likely that a First Right of Refusal may apply
to iwi if LINZ decides to sell this property.
LINZ currently retains the property at 9 Central Terrace because of the
possibility of other outstanding claims remaining for the Wellington
including (amongst others) Ngâti Tama. When LINZ has been advised by Te
Arawhiti (the department that leads the Crown in terms of Treaty of
Waitangi negotiations with remaining iwi groups) that the property is
available for disposal, LINZ will look to exercise this option – taking
into account any right of first refusal obligations that exist.
The property is currently tenanted and LINZ is required to give 42 days’
notice for vacant possession on transfer.
