Thanks for your reply. There is a lot of useful information contained within what has been returned but there are some problems with the way that the response has been handled that need to be addressed.

1) Combined response - I asked for responses to be separate. Combining the responses makes it harder to establish whether the question has been answered. Please do not combine your responses to separate requests. It frustrates the requester and those people that may access this OIA request at a later date.

There may be occasions where this is appropriate, but you would only know this by consulting with the requester. Consulting with the requester is required by the OIA - combining responses is not required. Where you are taking actions you need to consult.

Please separate out the MfEs responses to the OIAs - as they each stand on their own.

2) Excluding responses to the Select Committee that are publicly available. If you follow this link you will discover that he Parliamentary Select Committee web page is only searchable by keyword of the author - and not content. Therefore I cannot even find submissions that I know are there by searching for keywords included in the text. For example: https://www.parliament.nz/en/pb/sc/submi...

So there is no effective or practical way for members of the public to find the relevant information. Please provide the responses that relate to the information requested, or provide a response as to why this is not an appropriate service to provide the NZ taxpayer - under the OIA or any other duty/obligation?

A copy of the document is not necessary, but a link to the relevant documents would be a cost/time effective way to fulfill this obligation until such time as Parliamentary Services improves its search functionality.

3) Information in previous OIAs excluded - I have previously submitted an OIA but records mentioned in that OIA were not included in this one. https://fyi.org.nz/request/9425-all-docu...

It seems that would be easier for people who might access the latest OIA on the fyi.org.nz website (or where another citizen made an identical request) that all records were listed and included. This is what occurred in the previous OIA where the 4 Oct 2018 document was linked to on the website. This document has not been included/listed this time but the 12 June 2017 document has (although the emailed response has not been included this time).

Please state definitively whether the MfE excludes responses to previous OIAs from subsequent OIA responses.

Can you please describe whether the MfE's policy for responding to OIAs has changed since my previous OIA (in which case please forward the guidance and related documents approving this change).

Please correct your response to this OIA (which legally stands on its own) to make it more complete.

When correcting the MfE's response to make it more complete, please apply the same logic when referencing the 4 Oct 2018 document to my item (2) above and reference all relevant Select Committee submissions (and other publicly available documents) held by the MfE.

Note that I have not been able to read the Part 1 document above…. so my questions below are in response to your letter 19 D 02214 Chris Johnston letter vFinal.pdf which mentioned that:

“The response did not include reference to the names in your request, so is not in scope”

Could you please clarify the interpretation that is being applied of a Record and what is in scope to this request? Specifically:
1. An email trail that includes previous emails should be included where any of the emails in the chain mention the key words. The definition of a Record in the Public Records Act 2005 mentions the “original form”.
2. I argue that
2.1. An email as sent in its original form is one record (Record A), and the reply (which included the original email) was a second record (Record B).
2.2. For the purposes of efficiency I am happy for the reply (Record B that includes the original Record A) to be treated as one (that is send only Record B) when responding to an OIA, but
2.3. It is not compliant with the OIA or Public Records Act definitions to omit Record B and only send Record A.
3. Please confirm whether the response to this OIA has used the logic in (2.1 &2.2) or 2.3 above?
4. Please apply the logic in 2.2 above to this OIA in a revised response…… or state that the MfE will not …. or state that the MfE has already applied the logic in 2.2 in the Part 1 document that I cannot read.

Thanks for the response and information. Everything can be read - so I will close off this OIA.

In many ways this is the most disturbing of my OIAs that the Ministry for the Environment has responded to. This is because:
1) The MfE has got the completeness of its response wrong – twice
a. The original OIA – where the correspondence with the responder was omitted https://fyi.org.nz/request/9425-all-docu... and
b. This OIA – where the response to the member of the public was originally omitted, and upon outlining the requirements of the law in the OIA and Public Records Act, we finally get a more complete view.
2) The lack of evidence of due diligence and consulting scientific expertise in determining how the Nikoliov/Zeller published paper and findings impact on advice being given to Parliament and the wider NZ public by the MfE. Specifically no formal review or opinion was sought:
a. When the matter was first raised with the MFE
b. After my original OIA request
c. When a Zero Carbon Bill Select Committee submission highlighted that there is no evidence of professional scientific advice being sought by MfE
d. During the process of this OIA.

One would think, that for a “Carbon Free” initiative costing trillions of dollars to the New Zealand economy, there might be some documentary evidence of all the i’s and t’s being crossed – if it existed.

I request that:
1) This OIA and lack of due diligence be highlighted to the Chair of the New Climate Change Commission. As an ex-Reserve Bank Governor he should be well aware of the:
a. Documentary standard required before damaging actions on the New Zealand economy are undertaken.
b. Scientific caveats that need to be considered when assessing the real risk of climate damage. This published peer reviewed 2017 paper identifies that long term temperatures are stable – so any climate changes must be cyclic – and therefore many IPCC runaway warming scenarios are less (or not) likely.
2) Formal scientific and policy advice be sought and documented by the MfE and/or the Climate Change Commission on the Nikolov/Zeller published paper. This will cover your organisation and the State from future prosecution or embarrassment.

Thank you for your efforts on answering this OIA. This can be uncomfortable and administratively burdensome. I will follow up again on your progress.

2) Formal scientific and policy advice be sought and documented by the MfE and/or the Climate Change Commission on the Nikolov/Zeller published paper. This will cover your organisation and the State from future prosecution or embarrassment.

ITEM B) RELATED DOCUMENTS
Note that I have not been able to read the Part 1 document above…. so my questions below are in response to your letter 19 D 02214 Chris Johnston letter vFinal.pdf which mentioned that:

“The response did not include reference to the names in your request, so is not in scope”

Could you please clarify the interpretation that is being applied of a Record and what is in scope to this request? Specifically:
1. An email trail that includes previous emails should be included where any of the emails in the chain mention the key words. The definition of a Record in the Public Records Act 2005 mentions the “original form”.
2. I argue that
2.1. An email as sent in its original form is one record (Record A), and the reply (which included the original email) was a second record (Record B).
2.2. For the purposes of efficiency I am happy for the reply (Record B that includes the original Record A) to be treated as one (that is send only Record B) when responding to an OIA, but
2.3. It is not compliant with the OIA or Public Records Act definitions to omit Record B and only send Record A.
3. Please confirm whether the response to this OIA has used the logic in (2.1 &2.2) or 2.3 above?
4. Please apply the logic in 2.2 above to this OIA in a revised response…… or state that the MfE will not …. or state that the MfE has already applied the logic in 2.2 in the Part 1 document that I cannot read.
