Use of production orders to intercept telecommunications information
Alex Harris made this Official Information request to New Zealand Police
New Zealand Police did not have the information requested.
From: Alex Harris
Dear New Zealand Police,
Section 71 of the search and surveillance act 2012 allows police to apply for production orders for any document, including call-associated data and stored telecommunications, for any offence for which a search warrant could be granted. I would like to request the following information under the OIA:
* How many production orders have been applied for in the past year? How many have been granted? If possible, I would like a monthly breakdown.
* What offences have those orders been applied for to investigate? I'm interested in a breakdown of offences, or offence categories and broad severity, in order to determine the extent to which they are used to investigate minor vs serious offending.
I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.
With regards to s12 of the OIA, I am an NZ citizen and in NZ.
Yours faithfully,
Alex Harris
New Zealand Police

Dear MCMAHON, Teresa,
Thanks for your acknowledgement. Unfortunately I managed to leave something out of my request: I'm specificly interested in the number of production orders which target call associated data and stored telecommunications, and I'd like a breakdown of those too if possible.
Obviously this clarification restarts your 20 working-day clock.
Yours sincerely,
Alex Harris

It seems that the information MIGHT well exist, though it's hasn't been collated. Might be a case for the ombudsman here?
