Kia ora Elliot,

 

I am writing to you to clarify a couple of points in your Official
Information Act 1982 (OIA) request, received by the Ministry 4 June 2019.

 

In your request you have asked:

 

 1. ‘the annual rates of home detentions used in sentencing, from 2004 to
this year (15 years)’; and,
 2. ‘the most serious conviction concluding with the above data: GBH,
assault, sexual assault, etc.’

 

The points we need clarification on in order to get you the right
information are:

 

 1. When you talk about ‘annual rates of home detention…’ do you mean:

 

o the number of convicted charges that received a home detention
sentence each year?

or

o the number of convicted people who received a home detention sentence
each year? (this will count all people with a home detention sentence
regardless of whether it is their most serious offence in the year)

or

o the average length of home detention sentences when they were imposed,
each year?

 

 2. In regards to the second request ‘the most serious conviction … GBH,
assault, sexual assault, etc.’

 

We can provide data by the 16 ANZSOC divisions, which categorizes offences
into homicide, acts intended to cause injury (which is assault offences),
sexual assault, dangerous or negligent acts, abduction, robbery etc.

 

However, if we provide data by the 16 ANZSOC divisions, no information
will be visible for GBH as it is a subset of assault. Do you specifically
want information on GBH?

 

Also, please note the sentence of home detention was introduced in
mid-2007 as a result of the Sentencing Amendment Act, so we will only
provide data from 2007 onwards.
