Request for Information

 

I refer to your correspondence dated 21/02/2019 in which you requested "I
would like to request case file 11/02/2019 regarding a bus running a red
light on Jervois Quay on the 5th February".

 

I have considered your request in accordance with the Official Information
Act 1982.   Your request is refused pursuant to the following sections:

 

* Section 6(c) to avoid prejudice of the maintenance of the law,
including the prevention, investigation and detection of offences, and
the right to a fair trial;

This matter is still under investigation and your request has therefore
been refused under the above provision.
 
For future reference the police file number is 190213/6528.
 
If you are not satisfied with my response to your request you have the
right to complain to the Office of the Ombudsman and seek an investigation
and review of my decision.

Attention Barry Billows

Hi Barry,

Thats a bit confusing, as you already released that file to me (along with all my other reports I've submitted) on the 12th of March via a privacy act request which ended up being treated as an OIA request. I note that in my privacy act request I specifically said I didn't need the full file for reports I made, but oh well. Below is the file that I received. How come it was able to be released then, but not now?

From the look of the file at that point it looked like there had been no investigation at all since it was filed on the 13th of February. It once again appears that the Police are hiding the evidence that they do not act on traffic offences reported to them.

What Happened:
Bus entered intersection while no space on other side. Light turned red, pedestrians started walking. Bus starts Driving through causing pedestrians to wait
while they had right of way.
