Advice on electoral reform

Dear Andrew Little,

In November 2018 you indicated on Q&A that you were considering holding a referendum on MMP at the next general election. I would like to request the following information under the OIA:

* all advice on the proposed MMP referendum, including what questions may be asked.

In anticipation of an attempt to withhold information under s9(2)(f)(iv), I refer you to the Ombudsman's guidance on this section. s9(2)(f)(iv) protects tendered advice only while it is being actively considered. It does not protect "background material, or information that is purely factual or comprises bare options". It also only protects advice which is actually confidential; your public discussion of some of the options under consideration (lowering the threshold and removing the coat-tail rule) effectively waives any protection of those options, though recommendations or opinions on them may still be protected.

I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.

With regards to s12 of the OIA, I am an NZ citizen and in NZ
