Dear Auckland Transport,

I am chair of our local community group, Brookby Environment Protection Society. We understand that AT has assessed Twilight Rd in view of recent changes (Oct/Nov/Dec 2016) to its layout and structure as required by the resource consent granted to P. and I. Pascoe at 261 Twilight Rd, Brookby.

1. Can you please provide your safety audit report or any other relevant report relating to the Health and Safety aspects of Twilight Road as a result of your assessment.

2. Please also provide any recommendations made as a result of your audit.

Dear Auckland Transport,
A response to our request is now overdue. By law the response should have been due by the 18th April 2017. The information requested is required as part of the content of a environment court requested telephone conference to be held on Monday 24th April 2017 at 10am. The specific points being addressed have been copied below and the safety aspects of this road are relevant.
Please respond as required.

BEPS Specific points.

BEPS view is that, as the additional consent to operate a cleanfill in the clay pit which shares common conditions to the original Landfill consent should require public notification. This activity for the original consent attracted enormous public attention, was non complying and required public notification. More specifically the bundling of consents would seem appropriate. BEPS understands that this consent replaces an existing consent and is now silent on restricted operation times that were in the clay pit consent.

BEPS is of the view that the Roading upgrade to date is not in accordance with the plans, specifications and minimum standards presented to the Environment Court to ensure the Safety and amenity of the community. Auckland Transport have confirmed this. The carriageway placement due to the bank excavations not being completed as per the plans has now compromised the ability to achieve the required road width, the safe tracking paths as presented to the Court and the overall stability.

BEPS accepts the roading upgrade has yet to be completed however Council have advised that the roading upgrade has been signed off by the Consent holders consultant and have allowed cleanfilling to commence. This clearly contravenes the conditions of all consents granted.

BEPS believes that the Community Liaison Committee should have been set up and need to meet regularly. Auckland Transport should be in attendance while Roading works are in process.

Questions for Council

Why was there not a consultation process with the granting of the new consent and was due procedure followed?
Why did you approve Engineering plans that clearly did not meet the conditions of Consent?
Why did you not consult adequately with Auckland Transport when approving works on Twilight Road?
Why did you allow cleanfill trucks to use the substandard Road and if not why didn't you stop them?
Have you identified any clear breaches of consent and have any abatement notices been issued?
Why have you not insisted on the set up of the Community Liaison Group ?
Why are you documenting that a Road width of less than the Environment Court minimum standard stipulated would be adequate ?
Why when the Court clearly identified upgrading works were required from Kimpton Road to the Entrance to the cleanfill site, large sections have not been addressed as to the minimum Ausroads standard width of 7 metres for heavy vehicles?

Questions for P&I Pascoe

Does Pascoe believe ,that by providing Council with a report from their Consultant, that they have satisfied Condition 9 of the Consent and as such cleanfilling can commence?
Do they accept that the Road Width from Kimpton Road to the entrance of the Cleanfill site shall be of a minimum of 7 metres with a half metre berm as per the Ausroad standards for heavy vehicles?
Why have they not complied with condition 52 re setting up of a Community Liaison Group?

the LGOIMA and we are currently seeking further consultation in order to
finalise our response.

 

I have escalated the matter and hope to resolve your initial request by
tomorrow at the latest.
