Kia ora,
For each of the past five financial years, please provide aggregated information regarding the use of contractual cost recovery mechanisms in Wellington Water’s contracts with contractors.
Specifically, for each financial year:
1. The number of contracts entered into that included provisions for:
* liquidated damages,
* contractual deductions, or
* cost recovery for defective or non-compliant work
2. Whether such provisions are included as a standard term in Wellington Water’s contractor agreements (yes/no, with brief description if available)
3. The number of instances in which Wellington Water:
* applied liquidated damages,
* made contractual deductions, or
* recovered costs from contractors for defective, delayed, or non-compliant work
4. Where readily available, the total value of such recoveries per financial year (in aggregate)
5. The number of instances where:
* defective or non-compliant work was identified, but
* no liquidated damages, deduction, or cost recovery was applied
6. The number of instances in which the cost of rectification, repair, replacement, or other remediation of defective new work was:
-recovered from the contractor,
-borne by Wellington Water,
-borne by another publicly funded budget or programme, or
-borne by the property owner or another private party
If Wellington Water does not record cost allocation in that form, then please provide any equivalent aggregated information showing whether the cost of remedying non-compliant or defective newly installed works was recovered from contractors or instead met from Wellington Water or other public funds.
