Processes and policies for makinging a complaint with regards to the Law society and ombudsment
Grace Haden made this Official Information request to Ministry of Justice
Currently waiting for a response from Ministry of Justice, they must respond promptly and normally no later than (details and exceptions).
From: Grace Haden
Dear Ministry of Justice,
In 2018 at the request of a lawyer ( the requestor ) the then manager regularory of the law society Neil Mallon created two letters which were subsequently used in a tribunal and then in court.
the letters falsely stated that the requestor had held a practicing certificate in june 2006
IN 2006 the NZLS was not the registrar and in creating the letters Mallon did not conduct due diligence .
The purpose of the letters was to nullify corroborative evidence of the NZLS standards committee and the LCRO which both recorded that the requestor had not held a practicing certificate at that time .
Mallon’s letters sought to retrospectively refute that factual finding by claiming that she had held a practicing certificate .. this created the foundation for the requestor’s defamation claim against me
Based on his letters I have suffered 8 years of court action and am paying the lawyer who used the false documents $75,000 out of my $23,000 per annum pension , after she had already destroyed my ability to earn using the false letters
While the court of appeal has recognised errors by the court ( put simply they were misled through concealment of documents and strategy ) the appeal court believed it was not in the public interest to pursue an appeal and declined it.
I have made many complaints to the heavily conflicted law society who defend Mallon’s actions saying he was not a lawyer at the time ( he has been admitted since 2012) But the law society has never looked and are avoiding at looking at his conduct as an employee, I am simply blocked even writing to the CEO and the president has not brought a response
The law society is vicariously liable for their employee’s action .
The letters he created were false this is proved by a dossier issued by registrar at the time the ADLS ,though his own admission in an email to the requestor apologising for the error and in an affirmation of the requestor stating that this was in error.
Mallon is now an ombudsman .
It appears that there are no avenues for making a complaint about the past conduct of an ombudsman and the law society is not addressing issues regarding the conduct of their staff
In contrast I was a private Investigator and these false letters were instrumental in losing my ability to practice because of events 12 years earlier which based on these false letters were alleged to be defamatory
By way of OIA please provide with me with any policy and procedures by which a complaint can be made for review of the conduct of the law society and the ombudsman so that they are held accountable to the rule of law like the rest of us
If a private investigator can lose their licenced based on events 12 years earlier and alleged through false documents then the same degree of accountability should apply to an ombudsman who holds a significantly higher position in society
Yours faithfully,
Grace Haden
